All windows must be tight and all blinds and shades must be securely mounted and tightly secured in place. All electrical fixtures must be clean. PROCEDURE BEFORE SUBMITTING A REQUEST FOR REQUESTS Unit must be clean and free of any signs of mold, dampness, mildew, or rot. A professional must come and inspect the unit within 7 days of receipt. (See Appendix B for details.) When inspecting the unit, it is necessary to clean thoroughly and to remove any and all exterior stains. If mold or mildew were found on the unit, or if a mold/mildew smell was detected in the unit, the Department of Community Development (DCD) must be notified immediately. The unit must be completely cleaned and disinfected. (It is important to remember that if a building is not properly cleaned and disinfected, such as if it is located in a public park, it may not be considered a public building and therefore not be subject to the building code laws.) If mold or mildew are found on the unit, it will then be placed under the purview and inspection of the Department of Public Health (DPH). DPH will notify the District Office of Public Health of the findings. The unit will then be subject to inspection by a third-party inspection. If the mold and/or mildew have been discovered to be a significant health hazard, DPH must remove and disinfect the area at the end of the 7-day inspection. (If you do not agree to the Department of DPH's findings or actions, your choice is to seek relief from the Rent Stabilization Board (RSSB) and/or commence a private action against the Department of DCD. See the table on the left for information on how to begin a private action.) The property owner then must provide the Department of DCD with a written proposal for remediation. The unit will be immediately re-inspected by the DPH and will continue to be for 3 more days. At the end of that 3-day period, DPH must return a certificate of completion of mold and/or mildew cleanliness to DC-DCD. A “Notice of Violation” will be provided to unit owners by DC-DCD by mail. If the DC-D does not receive a satisfactory response within 7 days, DC-DCD must initiate a full inspection of the unit or remove the unit from all units and give an accurate cost estimate.
